On The Origin of the Genes of Viruses - 14


An informed public is the purpose of the Dredd Blog grey/gray literature which has appeared here now for over a decade.

Concerning viruses in general, I alluded to the uninformed public recently (if Cosmology is ...).

What would you think of a detective and/or prosecutorial team that had accused a person of being a mass murderer (without really knowing much of the background of the accused)?

For example, if they did not know the parents, the country of origin, the employer, the habits, the maker of the wheelchair the accused uses, or the whereabouts of the accused?

Would that perk up your interest and/or raise your eyebrows?

What if they used, relating to every shred of evidence alleged, the words "it seems", "it could be", "it suggests", "probably", and "we think" to describe their case (a case requiring PROOF beyond a reasonable doubt)?

Shouldn't a mass murdering event which is killing tens and tens of thousands of citizens from every walk of life require proof beyond a reasonable doubt?

Let's consider some questions a serious and competent detective would ask in order to detect the nature of  a suspect.

As to a suspect virus, can it reproduce/replicate itself:
"As viruses are obligate intracellular pathogens they cannot replicate without the machinery and metabolism of a host cell. Although the replicative life cycle of viruses differs greatly between species and category of virus, there are six basic stages that are essential for [pathogenic] viral replication."
(British Socienty for Immunology, emphasis added). Non-pathogenic mutualistic viruses are already inside cells, and do not need to invade because they help the host microbe stay alive and are therefore welcome.

So, would you want to know what the host cell is (its genome etc.)?

A host is like a "family" that brings a biological or viral entity into existence and keeps it from ceasing to exist  (in the sense that if a virus can't replicate/reproduce, then it will die out and become extinct without a host).

The reality about that aspect of viruses is that the relevant prevention science is lame or infantile in several ways, like incompetent detectives in the movie (The Usual Suspects) who had Kaiser in their office without ever knowing anything relevant about him.

So, with that in mind let me ask you when and where have you heard about THE HOST to the corona-virus / Covid-19 in the current media viral 24/7 storm?

I will just say that I have not heard the host even mentioned, and I have heard that viruses can't replicate themselves mentioned only once.

I have, however, heard in the media that viruses can replicate themselves (wrong).

Since most viruses inhabit microbes in a mutualistic relationship, which is beneficial, and since the host is much, much larger than its symbiont virus, why not look for the easier to find host?

I focus on the host, because the last thing a sane society wants to do is change the nature of a mutualitic virus into a pathogen by using antibodies that kill the host (BTW, a host that is helping the human species stay alive - see video below).

I. Before

When I wrote the previous post in this series about five years ago, I did not exactly envision that the news media would be talking about viruses 24/7 five years later.

Nor did I exactly envision one virus type killing more Americans than had died in the long Vietnam war.

But, I can say that I have covered the issues concerning the origin of viruses by contemplating their genetic characteristics and those of their hosts (On the Origin of the Genes of Viruses, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13; The Uncertain Gene, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11; etc. see the series tabs at the top of the page).

II. During

During the contemplation of the genes of viruses, uncertainty arose as a scientific principle or reality as the case may be.

Something caught my attention:
I kept thinking about the implications until it dawned on me that one aspect of the uncertain gene concept, elucidated upon in this series, is that proton tunnelling is also technically "epigenetic."

I mean that in the sense that any gene itself, in all genetic circumstances, does not "control" itself or anything else.

Thus Epigenetics, a discipline in and of itself, is a realm that studies what utilizes the genetic molecules, where those genetic molecules are utilized, when those molecules are utilized, how they are utilized, and why those molecules are utilized.

... the nomenclature of Epigenetics covers all activity that acts upon gene molecules, including those that decide whether, for example, to turn the gene on or off:
Geneticists study the gene; however, for epigeneticists, there is no obvious 'epigene'. Nevertheless, during the past year, more than 2,500 articles, numerous scientific meetings and a new journal were devoted to the subject of epigenetics. It encompasses some of the most exciting contemporary biology and is portrayed by the popular press as a revolutionary new science — an antidote to the idea that we are hard-wired by our genes. So what is epigenetics? - (Perceptions of Epigenetics)

Much work has been published on the cis-regulatory elements that affect gene function locally, as well as on the biochemistry of the transcription factors and chromatin- and histone-modifying complexes that influence gene expression. However, surprisingly little information is available about how these components are organized within the three-dimensional space of the nucleus. Technological advances are now helping to identify the spatial relationships and interactions of genes and regulatory elements in the nucleus and are revealing an unexpectedly extensive network of communication within and between chromosomes [cf. this]. (Nature Insight: Epigenetics, Vol. 447, No. 7143 pp 396-440). The point is that epigenetic dynamics involve multiple levels of analysis and subsequent operations ...
(ibid). The issue of Epigenetics (epi means above) informs us that in order to understand viruses we must have a handle on, an understanding of, their hosts.

Why?

Contrary to some media programs on TV, viruses do not replicate or reproduce, instead they are replicated or reproduced by machinery inside their host.

I am talking about a vast array machinery ("Ribosome: a sophisticated molecular machine") that is not part of any virus ... machinery that is part of the host microbe.

Even more interesting perhaps is that most viruses are mutualists, meaning that they do something helpful ("If not for a virus, none of us would ever be born") to their host (only a minority of viruses, the pathogenic viruses are harmful).

Why do they go crazy when their host is killed by chemicals and other antibiotics produced in the civilized world that is "at war" with the microbial world?

That is the same as asking "what causes viral diseases?"

III. After

Can you say "situation ethics" ...
"Small studies that build on basic science and preclinical research in early phases of drug development routinely generate signals of promise that are not confirmed in subsequent trials. Even when new drugs are established to be safe and effective, rarely are their benefits so massive that they can be detected in small, open-label, nonrandomized trials. The proliferation of small studies that are not part of an orchestrated trajectory of development is a recipe for generating false leads that threaten to divert already scarce resources toward ineffective practices, slow the uptake of effective interventions because of an inability to reliably detect smaller but clinically meaningful benefits, and engender treatment preferences that make patients and clinicians reluctant to participate in randomized trials. These problems are amplified by published reports of compassionate use, which was designed as an alternative pathway to access interventions outside of research, not to support systematic evaluation."
(Against pandemic research exceptionalism). Can you say "knee jerk reaction"?

Can you say "the traditional yellow peril" from Wuhan is quite erroneously the usual suspect?

Even as (what should be suspects) U.S. meat packing plants and other animal torture sites rack up the highest per capita covid-19 cases (places where the greatest overuse of antibiotics is centered)?

The possibility that virus pandemics can spring and spread from many origins is only as secret as Big Meat and Big Pharma want it to be:
"In addition, the meat and food industry are vulnerable to a variety of other infectious diseases that can manifest in food processing areas due mainly to poor personal hygiene and processing sanitation practices, which in turn can develop the growth of bacteria, viruses, moulds, and yeasts. These can then set the stage for:

Foodborne infection, such as salmonella or trichinosis, caused by ingesting food that is contaminated with bacteria, parasites, and viruses

Foodborne intoxication, either bacterial, such as E. coli, or chemical, where food has been contaminated with toxic chemicals, such as cleaning compounds or pesticides"

Scientists speak of both a pathogenic and a non-pathogenic corona virus (COVID-19 coronavirus epidemic has a natural origin) without discussing the microbial host (bats and camels are not microbes) or the circumstances that would change a non-pathogenic to a pathogenic virus.

Viruses can become pathogenic when a catastrophe (e.g. antibiotic killing) happens to their host (What Did The Mass Extinctions Do To Viruses and Microbes?).

IV. Closing Comments

Because we may be entering a new age of viral epidemics and pandemics, I am reopening this series that has been dormant for several years.

I am doing so in order to see if we can find the microbe that is being mass-murdered and thereby rendering the covid-19 virus host-less (homeless) like the boll weevil ... looking for a host (High Technology Boll Weevil).

Bull

All about bull
I. Get Bullish

Bull is a TV series that features and focuses on a company which specializes in court trials.

More specifically, Bull focuses in on the social science involved with jury selection.

Typically, law firms hire jury experts to inform them about the type of jurors that would be best suited for them and their client in a jury trial (Trial consulting).

II. Special Mob Bull

What mob boss would not love to be able to hand pick their own jury, a jury like The Donski (a.k.a. the president of the United States of America) has?!

Imagine a mob boss who is going on trial before a true jury of his peers (e.g. same crime family)?

I am talking about the jury who will hear the case of The Donski (The Shapeshifters of Bullshitistan, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20).

His jury has already been selected (the U.S. Senate) and has already indicated how they will vote.

In a Senate trial it takes 67 votes to convict and remove The Donski from office, following a House impeachment.

The Senate currently has 53 Republicans, 45 Democrats, and 2 Independents who both caucus with the Democrats.

Thus, it would take 20 Republicans voting guilty if all the Democrats and Independents vote guilty to reach the 67 required vote total.

A tough job even for Bull.

III. McTell News Bull

McTell News is all aflutter with hopey changey broadcasts emphasizing the fact that the public majority is in favor of impeachment and removal from office of The Donski:
"Currently, 52% say Trump should be impeached and removed from office, while 46% say he should not be. This is roughly the opposite of what Gallup found in June when asked in the context of special counselor Robert Mueller's investigation."
(Gallup Poll). No doubt about the direction this is heading, but heading in a direction is not the same as being there (it's all "are we there yet" at this point).

The McTell News folks under-emphasize the fact that only about six percent of Republicans polled in that Gallup Poll are in favor of impeachment and removal (down from seven percent a while back).

Like I said, a tough job even for Bull.

IV. Closing Comments

It would be malpractice for a lawyer to encourage a client in this situation, as it stands today, to expect a good outcome in that client's favor.

Especially if the client is the prosecutor or the majority in the House of Representatives.

Even though some of the jury's heroes (e.g.  4-star Admirals) indicate that The Donski is dangerously anti-American (Our Republic Is Under Attack From the PresidentAdmiral William McRaven: America Is ‘Under Attack’ From TrumpTrump: The Un-American President).

Can you see a despotic minority (How To Identify The Despotic Minority, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12)?

Blind Willie McTell News - 7

All The News We Think You Need
This series goes back a ways (Blind Willie McTell News, 2, 3, 4, 5, 6).

Concerning this subject matter, a piece over at Salon is a must read, so here are a few excerpts:
"For those who attended to the substance of Wednesday's congressional hearings featuring former special counsel Robert Mueller, they offered a cold, devastating reminder of how far our nation has fallen. Mueller, with his terse but honest responses to Democrats reading passages from the report that followed his investigation into Donald Trump's relationship to the Russian criminal conspiracy to hack the 2016 election, painted a devastating picture of a White House hijacked by a greedy criminal who will not hesitate to obstruct justice and betray his country for personal gain. Republicans, virtually to a person, exposed themselves as morally bankrupt lickspittles who eagerly lie and make up conspiracy theories, all to serve their orange-hued wannabe mobster of a master.

Square Finger 'Splainin'

The Square-Finger Gesture
If you watch politicians and media folk use their bag of on-camera gestures, one that is quite popular now is what I call the "square-finger" gesture.

It is common to all political party members and TV channel media members.

When I first noticed the wide array of spontaneous uses, I began to count how many times a day over the past year it was used during an interviewee's response/explanation to an interviewer's question.

The square-finger gesture is used to "help explain" subject matter of many types.

It does not seem to matter which pundit, what time of day, what type of TV news or talk show, what subject matter you are viewing, or whether the square-finger gesture is used to man-splain or woman-splain what the splainer is 'splainin'.
The insurrection was this big


No, the square-finger gesture is ubiquitous and shows up spontaneously.

After going through the mini-shock of even noticing the phenomenon in the first place, then seeking to make sense of it by attempting to count how many times a day it occurs, I next tried to make more sense of the square-finger gesture by determining the context in which the square-finger gesture was used.
Not even this much ...

I haven't finished that research, but at the moment it seems to be used when the 'splainer has some degree of fear attached to the subject matter being 'splained.

and ...

That is, it is used to minimize some aspect of the subject matter at hand by indicating "this subject matter is only this big, so I am in control of it" a la "Comparing a Group-Mind Trance to a Cultural Amygdala".

I have not yet finished my research on this, so help me out on this one by informing me and fellow Dredd Blog readers if you too have noticed the square-finger gesture (and don't forget to keep sending in your annual helpful responses to "My First Science Fiction Novel").

And let's not forget that any form of communication can be truthful or false, but gestures are probably a situation where proving someone was not "telling" the truth would be much more difficult to prove.

How could we tell if they were saying "taxes will only be this much" or "I was this close to winning" or "I was only going this fast officer"?

More only this much research is needed to know for sure.

Economic War Of The Pacific - 6

I. Background

This series began some years ago (2009) to point out what is becoming, more and more as time goes on,  news that is moving from the back pages toward the front pages of newspapers (Economic War Of The Pacific, 2, 3, 4, 5).

Today is what some call a "sacred" time when "we" intensify a focus on what "we" consider to be the supreme dynamics that produce what "we" call heroes and perhaps sheroes as "we" peruse history and herstory.

Yes, as "we" peruse events that took place during the many times "we" who are now of "Phase 27" (explained later) "lost it" ... along with the meaning of what that "it" was that "we" lost.

While D-day ("the largest seaborne invasion in history") gives an opportunity to swap 75 year old war stories, another gathering mentioned further back in newspaper pages looks toward the future:
"The deepening of the economic alliance between Russia and China will be high on the agenda as President Xi Jinping meets Russian President Vladimir Putin in Moscow on Wednesday amid their mutual estranged relations with the United States."
(Politico).

"Destroying arms control treaties is 'unacceptable,' Russian President Vladimir Putin said Wednesday during a bilateral meeting with Chinese President Xi Jinping at the Kremlin.

During the visit, which was aimed at cementing economic ties between the two countries amid China's heated trade war with the United States, Putin thanked Xi for helping their countries achieve a trade turnover of more than $100 billion a year. He added that Russian-Chinese relations have reached an 'unprecedented level'.

"Chinese President Xi Jinping has described Russia's Vladimir Putin as his 'best friend' during a three-day visit to Moscow focusing on trade and relations between the two countries.

The visit comes as China-US relations have soured over a bitter trade war.

Russia had decided on a pivot to the east years ago after ties worsened with the West over the Ukraine conflict.

The two sides have signed a package of trade deals and Mr Xi also unveiled two pandas for the Moscow Zoo.

The Chinese president arrived on Wednesday and later gave a press conference where he said he had a 'deep personal friendship' with his Russian counterpart.

'In the past six years, we have met nearly 30 times. Russia is the country that I have visited the most times, and President Putin is my best friend and colleague,' Mr Xi said.

Mr Putin echoed the praise saying he was 'pleased to say that Russian-Chinese relations have reached an unprecedented level. It is a global partnership and strategic cooperation.'" (BBC)
The lyrics of an "anti-war song" come to mind, a song which illustrates that things have not changed much since it was written:

"There's battle lines being drawn
Nobody's right if everybody's wrong
Young people speaking their minds
Getting so much resistance from behind
"

(For What It Is Worth). Can you imagine trying to calculate the "worth" of peace (How Much Is Peace Actually Worth?) while dwelling in a civilization that is quickly reaching Phase 27 ... in the history and herstory of civilizations (The Rus People)?

By "Phase 27" I am alluding to:
"In the Study Toynbee examined the rise and fall of 26 civilizations in the course of human history, and he concluded that they rose by responding successfully to challenges under the leadership of creative minorities composed of elite leaders. Civilizations declined when their leaders stopped responding creatively, and the civilizations then sank owing to the sins of nationalism, militarism, and the tyranny of a despotic minority."
(Encyclopedia Britannica, emphasis added). Adding a one to the previous 26, we calculate that we are at Phase 27, but where is that at (You Are Here)?

Unfortunately, along with the greatest generation which has already done all it can do now, "we" (Phase 27) are the only members of the group of 27 civilizations that have the ultimate power to stop it all.

By "stop it all" I mean stop life on Earth as we know it with a nuclear war and/or global warming induced climate change, either of which can eradicate "life's habitat" on this planet.

II. Foreground

The future is closer to us than the past is, i.e., the future is the foreground.

But, for some reason or lack thereof, "our cognition" lies to us and says that the foreground is further away than the background is.

III. Closing Conversation

Once upon a time in the Matrix:
"What is your background sir," asks the interviewer.

"I would rather contemplate my foreground sir," replies the interviewee.

When You Are Governed By Psychopaths - 8

This series began a little over six years ago.

It began with an observation that our culture was becoming psychopathic (When You Are Governed By Psychopaths, 2, 3, 4, 5, 6, 7).

Which of course was rejected by the "it can't happen here" crowd (LieGate).

This reality I was writing about is now here for all to see (President Trump's spokeswoman declines to say if press is 'enemy of the people' during combative briefing).

The second reaction to the subject of this series was to enter the individualism trance.

The toxins of that trance cause us to advance the notion that this is a one-person problem, rather than a 62,984,825 person problem.

When the people are consistently misinformed about real problems with rhetorical pabulum and deceit ("listen people, everything is going fine") then the direction a nation adopts is quite predictable (Agnotology: The Surge, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20; Etiology of Social Dementia, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18).

History told us this was going to happen:
But always TCS is primarily the population segment diagnosed as a despotic minority which the once most-often-quoted historian, Toynbee, fingered as one of the members of the trinity of extinction that he found in all civilizations that were about to become very successful at becoming extinct:
That something is the dementia that produces and ends up in suicide:
"In other words, a society does not ever die 'from natural causes', but always dies from suicide or murder --- and nearly always from the former, as this chapter has shown."
(A Study of History, by Arnold J. Toynbee). There is no cure for the final symptom of that group dementia, there is only prevention by way of avoiding it altogether in the first place.

The components of that group dementia were pointed out in an encyclopedia piece concerning that historian quoted above:
"In the Study Toynbee examined the rise and fall of 26 civilizations in the course of human history, and he concluded that they rose by responding successfully to challenges under the leadership of creative minorities composed of elite leaders. Civilizations declined when their leaders stopped responding creatively, and the civilizations then sank owing to the sins of nationalism, militarism, and the tyranny of a despotic minority. Unlike Spengler in his The Decline of the West, Toynbee did not regard the death of a civilization as inevitable, for it may or may not continue to respond to successive challenges. Unlike Karl Marx, he saw history as shaped by spiritual, not economic forces" ...
(Encyclopedia Britannica, emphasis added). The show stopper, in terms of remedy, in this type of group dementia is that it is a contagious dementia.
(Etiology of Social Dementia - 18). That particular "minority" is not a racial or ethnic minority, rather, it is primarily composed of a destructive suicidal trance (Choose Your Trances Carefully, 2, 3, 4, 5, 6, 7, 8).
(Arrested Development: The Creep State). Our culture is composed, now, of the toxins of power that habitually destroy nations and civilizations (Hypothesis: The Cultural Amygdala - 2).

Remember the prophesy of one of our founding fathers:
Our founders were well aware of the question and the answer hundreds of years ago.

They spoke the answer with unmistakable words and with certain clarity:
Of all the enemies to public liberty war is, perhaps, the most to be dreaded, because it comprises and develops the germ of every other. War is the parent of armies; from these proceed debts and taxes; and armies, and debts, and taxes are the known instruments for bringing the many under the domination of the few. In war, too, the discretionary power of the Executive is extended; its influence in dealing out offices, honors, and emoluments is multiplied: and all the means of seducing the minds, are added to those of subduing the force, of the people. The same malignant aspect in republicanism may be traced in the inequality of fortunes, and the opportunities of fraud, growing out of a state of war, and in the degeneracy of manners and of morals, engendered by both. No nation could preserve its freedom in the midst of continual warfare. Those truths are well established.
(James Madison, emphasis added). The visionary who made that statement was the 4th President of the United States, Bill of Rights author, Congressman, Cabinet Member, and who was also called the "Father of the U.S. Constitution".

This series focuses on the so called administration created by the so called educational system (Etiology of Social Dementia, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16).

It is an educational system handed down by the glorious few (The Virgin MOMCOM - 3), a.k.a. the 1% ("we are dominated by the relatively small number of persons", A Closer Look At MOMCOM's DNA - 4).

This segment deals with the tornado of propaganda, the ongoing political climate change black hole, a.k.a the Lord of the Lies.

I am writing about the star of the "Yeah, that's the ticket" room, who was given the nom de plume "Spice ER" by The Don.

It has been blazoned onto the name plate of his conservative fashioned lapel flag.

His job assignment is to give an education to the bad fake news people, who like to harass the dear leader of the glorious admin.

They do so by visiting the ER day in and day out in order to harass Spicey with questionable questions.

When The Obvious Becomes "Debatable"

I. The Spy Boss Knows

Notice this quote from the Security arm of the Director of the National Intelligence Agencies (DNI):
"This memorandum was prepared by the National Intelligence Council and was coordinated with the US Intelligence Community.

Long-term changes in climate will produce more extreme weather events and put greater stress on critical Earth systems like oceans, freshwater, and biodiversity. These in turn will almost certainly have significant effects, both direct and indirect, across social, economic, political, and security realms during the next 20 years. These effects will be all the more pronounced as people continue to concentrate in climate-vulnerable locations, such as coastal areas, water-stressed regions, and ever-growing cities."
(Report RE Climate Change, cf. Same in PDF). That memorandum mentions sea level rise several times, in the context of a threat to national security.

Both the military and the spies have known of the dangers to national security for at least a decade or so (Global Climate & Homeland Insecurity, 2).

Another branch of government, the congress, was loudly informed in 1988 (Global Warming Has Begun, Expert Tells Senate).

II. So Why Doesn't The Warming Commentariat Know?

"We" know that Humble Oil-Qaeda, now known as ExxonMobil, has known that it has been responsible for sea level rise for a long time.

That is, Humble Oil-Qaeda knows what causes sea level rise.

In 1962 they even put a centerfold, two page advertisement in Life magazine bragging about it:
“This giant glacier has remained unmelted for centuries ... Yet, the petroleum energy Humble [now ExxonMobil] supplies — if converted into heat — could melt it at the rate of 80 tons each second!
(Humble Oil-Qaeda). Thus, if sea level rise is caused by ice sheet and glacial melt (a national security threat according to the national security agency memo quoted above in Section I), then Humble Oil-Qaeda is itself a threat to national security.

Wouldn't that be a wake-up call for them to begin to avoid that issue, by diverting the focus?

And wouldn't that explain why Oil-Qaeda has been spreading their word through the warming science commentariat no less (The Warming Science Commentariat, 2, 3, 4, 5, 6, 7, 8) ?

I mean spreading the word that the ocean expands from sunlight hitting the sunlight zone (Epipelagic Magic).

Don't laugh, they have spread this "magic," like they have spread pollution of the ocean depths, into the deepest scientific depths:
"As the ocean warms, the density decreases and thus even at constant mass the volume of the ocean increases. This thermal expansion (or steric sea level rise) occurs at all ocean temperatures and is one of the major contributors to sea level changes during the 20th and 21st centuries" (IPCC).

"About half of the past century's rise in sea level is attributable to warmer oceans simply occupying more space" (National Geographic).

"Rising temperatures are warming ocean waters, which expand as the temperature increases. This thermal expansion was the main driver of global sea level rise for 75 - 100 years after the start of the Industrial Revolution" (Union of Concerned Scientists)..

" ... global sea level rises 0.26 m by 2100, and 0.56 m by 2199 through steric [thermal] expansion; " (Journal of Physical Oceanography, PDF).

III. But What About The Graphs Dredd?

Oh yeah, oops.

The graphs at Fig. 1 and Fig. 2 concern the West Coast of the U.S.eh?

The graphs at Fig. 3 and Fig. 4 concern the East Coast of the U.S.eh?

The data used to generate them, as usual, is from the World Ocean Database (WOD) and the Permanent Service for Mean Sea Level (PSMSL) database.

If thermal expansion is the MAJOR cause of sea level rise, why is sea level falling in those zones as ocean temperatures warm (Fig. 1, Fig. 2) ?

And why is sea level rising in the zones where the temperatures are falling (Fig. 3, Fig. 4) ?

IV. So Why Does The Citizenry Have To Sue Humble Oil-Qaeda?

Gotta try something?

In this context, historically the government through the Judicial Branch has protected Oil-Qaeda when it has been sued, because:
Here's the core constitutional fact: a progressive president and Congress now face a conservative judiciary, for the first time since 1937. Obama's ambitious agenda, if enacted, must go before federal courts—where judges can rewrite or strike down key provisions.
(A Case of Big Oil vs. Climate Change, 2). In that case the judges voted to have an en banc hearing, then recused themselves so that the case could not be heard (the judicially honest thing to do was recuse before, not after).

In the Oil-Qaeda oriented 5th circuit (covering oil states like Texas) most of the judges in the federal courts once lawyered for or are sympathetic to Oil-Qaeda.

Thus, they are the majority in (at least) one of the branches of government.

In other cases in less conservative circuits, the picture is also bleak (What Next, Mass Depraved-Heart Murder? - 2).

Maybe in Boston, where the runaways from England landed (hey pilgrim!), there will be a different result (CLV v Humble Oil-Qaeda) ?

Not likely.

V. The Problem Is Psychological,
Not Economic, Not Legal, Not Political

I will close with a quote from some of Sigmund's works:
If the evolution of civilization has such a far reaching similarity with the development of an individual, and if the same methods are employed in both, would not the diagnosis be justified that many systems of civilization——or epochs of it——possibly even the whole of humanity——have become neurotic under the pressure of the civilizing trends? To analytic dissection of these neuroses, therapeutic recommendations might follow which could claim a great practical interest. I would not say that such an attempt to apply psychoanalysis to civilized society would be fanciful or doomed to fruitlessness.
